New Delhi: the Supreme Court has granted interim medical bail to Satyendar Jain, the former Health Minister of Delhi, in a high-profile money laundering case. A vacation bench comprising Justices JK Maheshwari and PS Narasimha approved the bail application, allowing Jain to seek medical treatment at a private hospital of his choice for a period of six weeks. However, the court imposed certain conditions on him, including refraining from influencing witnesses, leaving the Government of National Capital Territory of Delhi (GNCTD) without the court’s permission, and abstaining from making statements to the press or media regarding any issue. The court’s order will be in effect until July 11.

Satyendar Jain’s arrest came in connection with a money laundering case initiated by the Enforcement Directorate (ED) following an FIR filed by the Central Bureau of Investigation (CBI) in 2017 under the Prevention of Corruption Act. The former leader of the Aam Aadmi Party (AAP) stands accused of laundering money through four companies allegedly associated with him. Since May of the previous year, Jain has remained in custody after properties worth Rs 4.81 crore were seized by the ED. The funds in question were allegedly owned by five companies.

Jain had appealed against the Delhi High Court’s decision on April 6, 2023, which had denied him bail. The high court had found no irregularities in the trial court’s rejection of Jain’s bail pleas on November 17, 2022. Highlighting Jain’s influential status and the potential for tampering with evidence based on his behavior during custody, High Court Judge Justice Dinesh Kumar Sharma stated that substantial probable cause was necessary to believe that the accused is not guilty of the offense in order to grant bail. The bench’s order pointed to Jain as the mastermind behind the operation, aided by Vaibhav Jain and Ankush Jain.

The court dismissed Jain’s claim of not being in physical possession of any property, emphasizing that physical possession of proceeds of crime is not a prerequisite for the offense of money laundering. Furthermore, the transfer of acquired shares back to Vaibhav Jain and Ankush Jain was deemed irrelevant, as it could be an attempt to conceal or project the proceeds of crime as untainted money. The bench noted that the companies involved were under the control and management of Satyendar Jain, and the fluctuating shareholding pattern indicated his indirect control over the company affairs.

With the grant of interim medical bail, Satyendar Jain will now have the opportunity to receive medical treatment while the legal proceedings continue. The case has attracted significant attention due to the high-profile nature of the accused and the allegations against him. As the trial progresses, further developments in the matter are anticipated in the coming weeks.
