Sunehri Bagh Mosque Case: Delhi High Court Transfers Hearing to Double-Bench

Sunehri Bagh Mosque cleric asserts its 150+ years age, labeling it a heritage symbol of cultural legacy in Delhi.

Sunehri Bagh Mosque Case: Delhi High Court Transfers Hearing to Double-Bench

The Sunehri Bagh mosque case, which has stirred controversy over the proposed demolition of the historic structure, recently saw a development as the single-bench hearing inside the Delhi High Court was transferred to a double-bench. The next hearing is scheduled for January 19, marking a crucial step in the legal proceedings.

Background: The case originated on December 30 last year when the mosque’s cleric, Abdul Aziz, approached the Delhi High Court in opposition to the New Delhi Municipal Council’s (NDMC) plan to demolish the mosque due to alleged traffic congestion in the area. The challenge was lodged against a public notice issued on December 24 by the NDMC, seeking objections and suggestions from the general public regarding the proposed demolition by January 1.

Legal Proceedings: Abdul Aziz’s petition contested the NDMC’s authority to remove a heritage structure, emphasizing that the law does not grant such power. The Delhi High Court accepted Aziz’s petition and scheduled a hearing, assuring that no immediate action would be taken as the Heritage Conservation Committee (HCC) had yet to make a final decision.

During the proceedings, the court questioned the locus of the Imam to file the petition instead of the Delhi Waqf Board. In response, Aziz’s counsel explained that the petition aimed to protect the congregation since the Sunehri Bagh mosque is a functioning and culturally significant structure that has stood for over 150 years.

Aziz’s Argument: Aziz’s plea highlighted the mosque’s heritage value, describing it as a symbol of cultural legacy. He argued that the traffic congestion in the area was not solely due to the mosque but also attributed to government buildings like Vayu Bhawan, Udyog Bhawan, and Udyog Bhawan Metro Station. Aziz contended that these offices had contributed to the traffic, disputing the NDMC and Traffic Police’s theory that blamed the mosque for the congestion.

The petition further emphasized that the traffic in the area was well-regulated, with barricades installed when necessary. Aziz asserted that neither he nor the worshippers had raised complaints about the traffic regulation measures.

Previous Proceedings: It is noteworthy that on December 18, the High Court had concluded proceedings in a separate petition by the Delhi Waqf Board, which anticipated the mosque’s demolition. The court recorded that all parties involved would act in accordance with the law.

Conclusion: As the Sunehri Bagh mosque case progresses to a double-bench hearing, the fate of this historic structure hangs in the balance. The legal battle raises questions about heritage preservation, the power of municipal councils, and the significance of cultural landmarks in urban planning. The court’s decision on January 19 will likely have far-reaching implications for the mosque and may set a precedent for future cases involving the preservation of heritage structures.

Bengaluru Rameshwaram Cafe Blast

Prominent BJP leaders have been vocal in linking the blast with what they perceive as the Congress’ support from minority communities. State president B Y Vijayendra pointed out the alleged “My Brother” policy of the Congress, referring to Deputy Chief Minister D K Shivakumar’s reported remarks addressing the accused of the Mangaluru cooker blast as “my brother.” Vijayendra emphasized that such politics of minority appeasement is endangering the safety of citizens.

The BJP leaders further cited a series of incidents that they claim occurred under the Congress regime, including the targeting of Hindu homes during Tipu Jayanti celebrations and the raising of pro-Pakistan slogans inside the Vidhana Soudha. They assert that the blast at Rameshwaram cafe is an extension of this trend, linking it to the earlier incident of “Pakistan Zindabad” slogans being raised.

Leader of the Opposition R Ashoka condemned the Congress’ appeasement politics, alleging that it promotes a mentality of safeguarding irrespective of actions. He urged against turning Bengaluru into “Bomb Bengaluru” and called for responsible governance.

Bengaluru South MP Tejasvi Surya criticized the Congress government’s handling of the situation, questioning their preemptive narratives and vote-bank compulsions. He urged for a fair investigation without biases.

BJP national general secretary (organisation) B L Santhosh lamented the consequences faced by Bengaluru and Karnataka due to what he perceives as the extreme appeasement policies of the elected government.

In conclusion, the BJP’s stance on the Bengaluru blast underscores their concerns regarding the alleged appeasement politics of the Congress. They advocate for a transparent investigation to ensure the safety and security of citizens, emphasizing the need for accountable governance.
